In2cable
reserves the right to verify the information provided
by the Subscriber in the application form, to use
the same at its discretion and the right to grant
or refuse the Services to the Subscriber. |

| 3 |
|
This
contract shall run in concurrence with License Agreement
between Department of Telecommunications and Ministry
of Communications, Government of India and the In2cable
for the operation of Internet services subject to
other terms and conditions of this contract. |

|
|
| 4 |
|
In2cable
agrees to provide Subscriber with the services on
the terms and conditions of this Contract. |
| |
|
|
| 5 |
|
The
services are provided on an "AS IS and AVAILABLE"
basis for decent and lawful purposes without any
warranties of any kind.
|

|
|
| 6 |
|
In2cable
does not guarantee error free services or that any
information, software or any other material accessible
through services is free of viruses, worms, Trojans
horses or other harmful components. |
| |
|
|
| 7 |
|
The
services remain In2cable’s exclusive property and
at the end of the contract, the subscribers’ right
to use the services ceases. |
| |
|
|
| 8 |
|
Subscriber
is responsible for and must provide all access to
equipment necessary to access the services. In2cable
reserves the right to disconnect or deactivate Subscriber’s
access to services without prior notice including
in situations where Subscriber’s equipment or software
is interfering with In2cable’s other services. |

|
|
| 9 |
|
Subscriber
should use Cable modem/Router/ any other equipment
approved/supplied by In2cable. |
| |
|
|
| 10 |
|
The
subscriber shall permit In2cable or its authorized
representatives sufficient and timely access during
any day of the week to verify/install/inspect the
necessary ‘equipment’ at the Subscribers’ premises.

|
|
| 11 |
|
In2cable
is merely a provider of Cable Modems/ Routers or
any other hardware that may be required to enable
the services. Such equipments shall carry such warrantees
as provided by the Original Equipment Manufacturer. |

|
|
| 12 |
|
Subscriber
agrees to pay In2cable the installation, activation,
subscription and other charges along with the statutory
taxes and levies that are in force at the time of
such payments as and when they fall due as may from
time to time be notified by In2cable. |

|
| 13 |
|
In2cable
will invoice/bill Subscriber on a periodic basis
it will be either posted, couriered, e-mailed or
faxed to the Subscriber. However, it will be Subscriber’s
responsibility to inquire about Subscriber outstanding
and in case of non-receipt of bill, Subscriber will
have to contact In2cable and pay the amount due
by the due date. In2cable shall not be responsible
for any delay or loss in transit of bill. In2cable
reserves the right to withdraw/suspend/terminate
the services partially or fully with or without
notifying Subscriber in case of non-payment of invoice/bill
by the due date or in case Subscriber’s payment
instrument is returned unpaid to In2cable for whatever
reason by Subscriber’s bankers. And in case of discontinuation/disconnection
of service the charges/fees paid by the subscriber
earlier shall not be refunded under any circumstances
whatsoever. |

|
All
Payments must be made in full by the due date mentioned
in the invoice/bill. Any delay in payment by the
due date will attract interest @ 2% per month. In
case of dishonour of cheque, subscriber will be
liable to pay a penalty of 2.5% per month of the
value subject to a minimum of Rs 150 per instrument
and any other charges as may be applicable. |

|
Reinstatement
of services will require full payment of outstanding
balance and other charges plus installation fees.
It shall be In2cable’s sole discretion to allow
such reinstatement of the services in full or partially.

| 16 |
|
All
the terms and conditions of the services and payments
shall be notified by In2cable from time to time
by way of services terms & conditions and shall
be binding on Subscriber. All the subsequent services
manuals /Packages/ booklets etc., issued by In2cable
from time to time shall be binding on Subscriber. |

| 17 |
|
Reproduction
or distribution, publication, copying, downloading
or exploitation of any Third Party Content by the
Subscriber will hold the Subscriber liable for infringement
of Copyright or any other applicable law. |

|
| 18 |
|
Subscriber
is required to ensure that objectionable or obscene
messages or communications, which are inconsistent
with the established laws of the country, are not
generated/ sent by the Subscriber. Subscriber understands
that the Internet contains unedited material, some
of which is sexually explicit or pornographic that
may be offensive to some people and access to such
material will be at Subscriber’s own risk. |
